The Australian drug addict who was sentenced for the robbery of Jason Potter during the Aussie Millions 2008 has failed in his appeal against his 4-year jail sentence. Dwayne Johnstone, 34, will spend at least two years behind bars before being eligible for parole.

The American pro Jason Potter (pictured) was robbed of his winnings at the Aussie Millions 2008 after he had collected $31,075 in cash at the Crown Casino, Melbourne. Johnstone, who had been stalking the casino looking for a victim, spotted Potter and followed him outside, then hit him in the head and robbed him near his hotel.

Johnstone pleaded that he was a drug addict and suffering from a brain damage, but the court was not sympathetic. Johnstone, who has 69 previous convictions, had been smoking crystal meth and marijuana before the attack and was on parole at the time.

Johnstone was sentenced to four years in prison, of which he will serve at least two years before being eligible for parole.
